Sales Terms



1. The object

These General Terms and Conditions of Sale define the rights and obligations of the parties in the context of the remote reservation of services offered by La TILLAIE on its website and Mobile Services.
They govern all the steps required for the reservation and the follow-up of the reservation between the contracting parties. All reservations, therefore, imply the client's full and unreserved acceptance of these terms and conditions. All customers acknowledge that they have the capacity to contract, i.e. that they are of legal majority and are not under guardianship or curatorship. The names "establishment" and "site" refer throughout this text to the site named www.latillaie.com and correspond to the domain name that can be consulted at www.latillaie.com.

2. Fields of application

These GTC apply to all bookings made via the internet, the website or mobile services or those of its partners.

3. Enforceability of the general terms and conditions

In any event, the version of the general terms and conditions of sale binding on the customer is that in force at the time of his reservation on the website or mobile services or those of its partners.

4. Reservations

Reservations are made on the website, by e-mail, by post or by telephone. The reservation will be effective only if it is guaranteed by the customer, by communicating a credit card number with validity date.Payment for all services will be made directly to the establishment (exception made for prepaid reservations at the time of booking). 


5. Payment

In case of payment by credit card or bank transfer, the establishment will collect the total price of the reservation made by the customer one month before the effective date of the first day of the booked stay.In case of payment by cheque, cash or holiday vouchers, the total amount of the stay is to be paid on arrival. The establishment reserves the right to cash the total amount of the stay one month before the effective date of the first day of the booked stay thanks to the details on the card.bank details transmitted at the time of booking.This sum will be refunded in full as soon as payment by cheque, cash or Chèques Vacances has been made.


6. Modifications of the stay

Any modification of the stay must be requested by e-mail to the establishment or by telephone. The request will only become effective once the establishment has confirmed its acceptance by e-mail.In case of modification of stay, the following conditions apply (except in case of force majeure):-In case of no-show on the scheduled arrival date, your credit card will be charged for the first night.-Any stay started is entirely due.

7. Cancellation of stay

Any cancellation of stay will have to be the subject of a request by e-mail to the establishment or by telephone. The request will only become effective once the establishment has confirmed its acceptance by e-mail.In case of cancellation of stay, the following conditions apply (except in case of force majeure):-For all requests made less than 30 days before the planned date of arrival, the total amount of the stay will be invoiced and debited by means of the credit card transmitted at the time of booking.-In case of no-show on the date of arrival, the total amount of the stay will be charged and debited by the credit card provided at the time of booking.
-Any stay started is entirely due.

8. Force majeure

Force majeure is understood to mean any event outside the parties that is unforeseeable, insurmountable and external to the parties that prevents either the customer or the establishment from fulfilling all or part of the obligations provided for in the contract. Are considered as cases of force majeure or fortuitous those usually recognized by the jurisprudence of the French Courts and Tribunals.Each party shall not be held liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that an event of force majeure suspends the parties' performance of their mutual obligations and that each party shall bear the costs arising therefrom.

***In the case of COVID-19 the establishment accepts last-minute modifications and stays if a new containment or traffic restriction should be decided by the government.***


9. Prices 

Prices are always indicated in EUROS. VAT is always included.The prices indicated only include the service indicated in the reservation.The additional services provided by the establishment during the stay will be added to the price mentioned in the booking and, on thewhere applicable, the tourist tax. The applicable prices are those in force on the day of the reservation. Only the price indicated in the booking confirmation is binding. 

10. Claims and disputes

All complaints must be made to the establishment within 7 days from the date of stay."In accordance with articles L.616-1 and R.616-1 of the Consumer Code, we offer a consumer mediation system. The mediation entity selected is: CNPM - MEDIATION DE LA CONSOMMATION. In the event of a dispute, you can submit your claim on its website: https://cnpm-mediation-consommation.eu or by post by writing to CNPM - MEDIATION - CONSUMPTION - 27 avenue de la libération - 42400 Saint-Chamond - France ".In the absence of recourse to the conventional mediation procedure or to any alternative dispute resolution method within 30 days, either party may refer the matter to the competent judicial court. 

11. Responsibilities

It is the responsibility of the establishment to take all guarantees and insurance necessary for the reception of the public in its establishment and the exercise of its activity. The establishment's responsibility in the event of theft of goods or objects when they have been entrusted to its custody only. The customer must ensure the custody of his goods and objects. The customer must inform the establishment of any damage he may have caused. He is responsible for all damage caused by his intermediary and undertakes in the event of damage to the premises placed at his disposal to bear the costs of restoration. Also, any behavior contrary to good morals, public order, or considered as endangering the life of others, will lead the establishment to ask the customer to leave the establishment without any compensation and or without any refund if a payment has already been made. In the event that no payment has yet been made, the client will have to pay the price of the nights consumed before leaving the establishment. 

***In the case of COVID-19, the customer being warned, the payment of the stay will be due in its entirety. In the event that a client presents symptoms during their stay, the establishment will impose isolation in their room and a temperature reading. If the client refuses or if the client voluntarily conceals symptoms, the establishment has the right to refuse the service and end the client's stay. The remainder of the stay will be due. ***The customer undertakes not to invite any person without the prior agreement of Mr. Olivier ROTENSZTAJN. In any case, if the guest's behavior is likely to be detrimental to the establishment, the latter reserves the right to intervene.
